Suit: Gutter installer suffers serious injuries after fall at job site

HOUSTON — A gutter installer who fell at a job site and suffered serious injuries is claiming his employer's negligence. 

Jose Guadalupe Saucedo filed a complaint Jan. 27 in Harris County District Court against Katy Kustom Gutter LLC alleging negligence. 

Saucedo, according to his complaint, was an employee of Katy Kustom Gutters on Dec. 2, 2022. He claims the company was hired to provide gutter repairs and installations and that while installing a gutter, he suddenly fell without warning. Saucedo alleges he suffered injuries to his heel, neck, shoulder and other parts of his body. He claims Katy was negligent for failing to maintain its equipment in a safe condition, failing to warn him of the hazard or mark the dangerous condition. 

He also claims Katy failed to take appropriate action to protect its employees and timely and appropriately correct the known hazard. Saucedo alleges Katy was negligent in its hiring, managing, training and supervising of its employees. He also alleges Katy is a non-subscriber to Workers' Compensation and that he incurred medical care costs and suffered lost wages. 

Saucedo seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Kurt Arnold, Caj Boatright, Roland Christensen and Alec Paradowski of Arnold & Itkin LLP in Houston.
