GALVESTON — An Airbnb renter alleges he suffered back injuries after a chair he sat in cracked and broke into pieces.
Lewis Toussant filed a complaint Feb. 7 in Galveston County District Court against Cottonwood Trail Investments LLC alleging negligence.
According to his complaint, Toussant was renting the defendant's Airbnb on Grambo Boulevard in Galveston on Jan. 1, 2023. He claims that while he and his family were eating dinner, the chair he was sitting in cracked and broke into several pieces and caused him to suffer injuries to his back.
Toussant alleges Cottonwood Trail's negligence for their failure to maintain the premises and inspect the property. He also alleges the defendant failed to correct the dangerous condition or warn of the hazard and claims they knew or should have known about the condition of the defective chair. Toussant claims he suffered pain, impairment, disfigurement and incurred medical expenses as a result of the defendant's negligence.
Toussant seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Michael Garatoni of The Daspit Law Firm in Houston.
