Suit: Couple failed to pay landscaping startup company loan

GALVESTON — A Houston man alleges in a breach of contract claim he is owed more than $200,000 for various loans to a friend's family.  

Joe Dee Barlow, 116 S. Kemah Dr., LLC, Ottawa LLC and Barlow Global Investments filed a complaint Feb. 3 in Galveston County District Court against KTS Landscape and Irrigation LLC, Leonard "Scott" Schroeder and Katherine Tunstall Schroeder also known as Katherine Ann Tunstall alleging breach of contract. 

The plaintiff alleges that he made a series of loans to the defendants including in December of 2020, when Schroeder and Tunstall faced financial trouble and needed $39,392.44 to make repairs to their residence prior to selling the home. The plaintiff claims he also helped the couple find new housing and leased them a home in Kemah for $3,000 and that the defendants failed to pay $18,400 in rent. 

The plaintiff alleges that in January of 2021, he loaned the defendants $47,875 for Schroder to start KTS Landscaping and Irrigation and that $38,061.39 is still due on that loan. The plaintiff also alleges he loaned the defendants money needed for "cash/flow/working capital purposes" and is owed more than $100,000. 

The plaintiff seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by R. Talmadge Hammock and Kristin Munkittrick of The Hammock Law Firm PLLC in Houston.
