Tenant at Santa Fe apartment claims leaky water heater caused slip & fall

GALVESTON — A tenant at a Santa Fe apartment complex alleges a leaky hot water heater caused her to slip and suffer serious injuries. 

Judy Hodges filed a complaint Feb. 8 in Galveston County District Court against DMA Properties LLC, DMA Property Advisers LLC, DMA Development Company LLC and Bayou Country Housing Trust Fund Inc., alleging premises liability. 

Hodges, according to her complaint, was a resident at the defendants' The Heritage Crossing Apartments on 11th Street in Santa Fe. She claims that on May 24, 2021, she slipped due to a hot water heater that was leaking and suffered serious and permanent injuries. 

Hodges claims the defendants had actual or constructive knowledge of the dangerous condition and failed to warn of the hazard. She also claims as a result of her slip and fall, she suffered pain, impairment, disfigurement, mental anguish, lost wages and incurred medical expenses. 

Hodges seeks monetary relief, interest and all other just relief. She is represented by Ciro Samperi and Kyle Knizer of Criaco & Samperi in Houston.
