Homeowner claims faulty construction caused home to be demolished by flooding

HOUSTON — A homeowner claims faulty construction on her new home caused the residence to be demolished by flooding. 

Abby Temeng filed a complaint Feb. 13 in Harris County District Court against InTownHomes LTD and InTownBuilder GP LLC alleging violation of the Deceptive Trade Practices Act, fraud and other claims. 

According to her complaint, Temeng purchased a new home from InTown in September of 2018. She alleges the home had numerous defects from the time she moved in and after Winer Storm Uri hit Texas in 2021, even more defects were revealed. Temeng claims the home was demolished by flood water due to a cracked tankless water heater and a a drain pan that was improperly secured. 

Specifically she claims the drain pain was mounted in the air with no support and was 15-20 inches above the deck/flooring causing water to flow down the walls and ceilings of the house. Temeng alleges she spent close to $400,000 for extensive remodeling to make the home habitable again and had to leave the home for 15 months. She claims the defendants made false representations about the quality of the home and failed to provide a well built house free of defects. 

Temeng seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Kevin Michaels of The Law Offices of Kevin R. Michaels PC in Houston.
