Woman alleges defective parking garage gate damaged vehicle

HOUSTON — A woman alleges the owners of a property where the parking garage gate suddenly closed on her vehicle is refusing to pay for her car's significant damages. 

Vonda Shields filed a complaint Feb. 11 in Harris County District Court against CXRE Properties and Naina Chimney Rock LLC alleging violation of the Deceptive Trade Practices Act, negligence and premises liability. 

Shields alleges in her complaint that she was exiting the parking garage on the defendants' property on Chimney Rock Road in Houston on Dec. 29, 2022. She claims that the automatic exit gate was open and that she started to drive her vehicle through the gate, it suddenly began to close rapidly for no reason. Shields further claims there was a vehicle directly behind her preventing her from reversing her car and was forced to continue forward through the gate. 

She alleges the gate collided with her vehicle and caused considerable damage to her car. She claims she informed the defendants about the incident and that despite her providing a police report and car repair estimate to the defendants, they have refused to accept liability or compensate her for their defective parking gate. 

Shields seeks monetary relief of $250,000 or less, interest, trial by jury and all other just relief. She is represented by Attorney M. Chappell in Houston.
