HOUSTON — A man alleges a slippery substance on the floor of the steps at the Cinemark Theater in Houston's Memorial Mall caused his fall and injuries.
Forest B. Carter filed a complaint Feb.22 in Harris County District Court against Memorial City Mall LP, Metro National Corporation and Federal Cleaning Contractors Inc., alleging premises liability and negligence.
Carter, according to his complaint, was leaving the Cinemark Theater in the Memorial City Mall on Nov. 16, 2022. He claims he slipped and fell on an "unidentified hazardous liquid" on the steps in the mall and suffered injuries to his elbow, back and neck. Carter alleges the defendants' negligence for failing to ensure the stairwell did not have a hazardous condition, for failing to warn of the hazard and by not properly having the steps maintained.
He also alleges the defendants were negligent for failing to inspect the steps and for its failure to supervise its employees and contractors who were responsible for maintaining the area. Carter alleges he suffered impairment, loss of wages, disfigurement and incurred medical expenses as a result of his fall.
Cater seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Steven Hollingsworth and Chelsea Murfree of The Hollingsworth Law Firm PLLC in Houston.
