Suit: Concrete material company failed to be paid for high school project

GALVESTON — A concrete materials company claims it was not paid for a repair project at Santa Fe high school and is owed more than $90,000. 

Alamo Concrete Products Company filed a complaint March 8 in Galveston County District Court against Fielder's Choice Inc., Charles Thomas Worthen and Markel Surety Holding, as parent subsidiary of Suretec Agency Services alleging breach of contract and other claims. 

Alamo alleges in its complaint that it supplied concrete materials to Fielders for an a synthetic turf and track repair project at Santa Fe ISD's High School. They claim that Alamo still has a balance owed of $93,092.85 and notified Markel of its claims against the payment bond for the project in October of 2022. 

Alamo further claims it has sent both oral and written demands for payment to the defendants yet they are still uncompensated for the materials supplied for the project. They also claim the defendants are in violation of the Prompt Pay Act and in breach of the Texas Construction Trust Fund Statute.

Alamo seeks monetary relief of less than $100,000, interest and all other just relief. They are represented by Sean McNelis of McNelis + Associates PLLC in San Antonio.
