Woman slips from oily lubricant on just repaired escalator at Galleria Mall, suit claims

HOUSTON — A woman who allegedly fell on an oily lubricant left on an escalator at the Galleria Mall in Houston is claiming negligence. 

Lydia Perez filed a complaint March 7 in Harris County District Court against Simon Property Group LP and HG Galleria LLC alleging negligence. 

According to her complaint, Perez worked as a tailor for various high-end retailers in the Galleria Mall. She claims on Oct. 9, 2022, while accessing the escalator on the mall's rink level, she slipped on an "oily substance/lubricant" and fell to the ground. Perez alleges the fall caused her to break her arm and that up until the day of her fall, the escalator had been under repair and was non-operational for weeks and had just re-opened. 

She claims the defendants' negligence for allowing the dangerous condition to exist and for failing to take steps to warn of the hazard located on the escalator. Perez alleges she suffered impairment, mental anguish, lost earnings and incurred medical treatment expenses as a result of her fall. 

Perez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Richard Hinojosa and Justin Burrow of Hinojosa Law PLLC in Houston.
