HOUSTON — A worker injured at a Marathon Petroleum facility after falling in a hole that was several feet deep is claiming negligence.
Shandreka Simmons filed a complaint March 15 in Harris County District Court against Turner Industrial Services LLC, Repcon Inc., BHI Energy Specialty Services LLC and Marathon Petroleum Company LP alleging negligence and other claims.
According to her complaint, Simmons was working for On Point Industrial Services at a Marathon Petroleum facility in Texas City on Feb. 14, 2023. She claims the defendants left a hole with a gap of more than two inches uncovered which she stepped into as she was surveying the area. Simmons alleges the hole was several feet deep and was not barricaded, tagged or secured.
She further alleges Marathon was aware of the unsecured hole and that all the defendants, including safety representatives walked by the hole on a daily and hourly basis. Simmons claims the defendants' unsafe work practices violated basic OSHA and Texas Labor Code rules. She alleges she suffered lost earning capacity, disfigurement, impairment and incurred medical expenses as a result of her injuries.
Simmons seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. She is represented by Anthony Buzbee and Bret Griffin of The Buzbee Law Firm in Houston.
