Couple claims they were harassed and assaulted at Waffle House, sue for $2M

GALVESTON — A couple is alleging they were harassed and attacked by another customer at a Waffle House.

Seeking monetary relief over $2 million, Clayton Henderson individually and Sofia Locke individually filed a complaint March 15 in Galveston County District Court against Waffle House Inc., and Marcus Nelson Jr., alleging premises liability. 

According to the plaintiffs' complaint, they ordered take out from Waffle House while traveling from Alabama on March 27, 2021. They claim Nelson began harassing Locke with lewd gestures while she was inside the Waffle House ordering their food. The plaintiffs claim that Locke then left the restaurant to go get Henderson to come back inside with her when Nelson suddenly charged at him and an altercation started. 

They further claim Nelson punched Locke and caused her to abruptly hit the wall. They allege as they tried to flee the restaurant, Nelson violently struck Henderson with his vehicle. The plaintiffs allege Waffle House knew of the crimes in the area for years and failed to take reasonable safety precautions such as having security guards on the premises. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by Jonathan Cox of The Cox Pradia Law Firm in Houston.
