Suit: pool contractor paid more than $19,000 abandoned job

GALVESTON — A homeowner alleges a pool contractor she paid more than $19,000 did poor workmanship and abandoned the job. 

Theresa Brass-Nash filed a complaint March 23 in Galveston County District Court against Galveston Lawncare LLC doing business as Kelly's Pool & Spa alleging breach of contract and violation of the Texas Deceptive Trade Practices Act.

According to her complaint, the plaintiff entered into a contract with Kelly's Pool & Spa in June of 2021 for renovations to an existing pool at a cost of $30,000. She claims the contract called for a down payment of $15,000 and the remaining $15,000 at time of completion of the project. The plaintiff further claims the estimated completion was 39 days and that in August of 2021, she paid an additional $4,500 to the defendant. 

She alleges the defendant's workers appeared to not have proper experience and had no supervision. She also alleges there were flaws in the work such as bubbles on the epoxy coating and uneven coverage and missed spots. The plaintiff claims the defendant failed to complete the job and abandoned the project after being paid $19,500. She also claims she had to pay another contractor more than $38,000 to complete and correct the project. 

The plaintiff seeks monetary relief, interest and all other just relief. She is represented by Craig Saunders of Craig W. Saunders PLLC in Houston.
