GALVESTON — A couple alleges a home builder they advanced more than $60,000 to failed to build their home.

Jonathan P. and Jane M. Holmes filed a complaint March 21 in Galveston County District Court against Lenlee Homes LLC and John Lee Thompson, Jr., alleging breach of contract, fraud and other claims.

According to their complaint, the Holmes entered into a contract in November of 2021, with the defendants to construct a home on Snowy Egret Drive in Galveston. They claim Lenlee required them to get a construction loan to enable the ordering of windows and other construction materials. The Holmes allege that despite advancing $60,250 to the defendants, they failed to order any material or move forward with any of the contractual obligations.

The Holmes also claim the defendants made false promises and strung them along for months and then informed the Holmes that they could not build the home due to the lack of time remaining on their loan. They allege they are now "on the hook for the construction loan without an inkling of a home to show for it."

The Holmes seek monetary relief, interest and all other just relief. They are represented by Kyle Dickson, Philip Nolen and Sarbjit Nagi of Murray Lobb PLLC in Houston.
