Kroger customer alleges dangerous condition cause her slip & fall

GALVESTON — A Kroger customer alleges employees knew of a dangerous condition that existed which caused her slip and fall. 

Verna Gutierrez filed a complaint April 5 in Galveston County District Court against Kroger Texas LP alleging premises liability and negligence.

Gutierrez, according to her complaint, was at the Kroger store in League City on April 5, 2021. She alleges that as she was walking through the store, she slipped on a substance and "landed forcefully on the ground." Gutierrez claims customers notified Kroger of the dangerous condition at that store and other Kroger stores across the country and that Kroger employees witnessed accidents caused by the hazard. 

She also claims Kroger's negligence for failing to maintain its premises in a safe condition and for failing to warn of the dangerous condition. Gutierrez alleges Kroger failed to inspect the premises or warn of the dangerous condition which caused her to suffer impairment, mental anguish and lost wages. 

Gutierrez seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Jeffrey Todd of The Todd Law Group in Houston.
