Counterpoint Energy alleges excavation contractors damaged utility pole

GALVESTON — Centerpoint Energy alleges contractors caused more than $7,000 in damage to one of the utility poles in Seabrook during excavation work. 

Centerpoint Energy Houston Electric LLC filed a complaint April 4 in Galveston County District Court against Timothy Leppard and John Doe Plumber alleging negligence, trespass and other claims. 

Centerpoint alleges in its complaint that on July 2, 2021, the defendants' agents damaged their utility pole with an attached transformer located on Kingston Harbor Drive in Seabrook during an excavation, sewer line project. They claim the defendants destabilized the utility pole and its cement base during digging which caused the pole to fall over. 

Centerpoint also claims the defendants failed to have the location properly marked and failed to have the pole braced which caused them $7,659.04 in repair costs. Centerpoint also claims the defendants failed to have proper guidance and instructions for its employees and did not report the damages to them or to the proper authorities. They alleged the defendants were also negligent for failing to properly inspect the area and that their actions created a dangerous condition for the safety of others. 

Centerpoint seeks monetary relief, interest and all other just relief. They are represented by Jeffrey Oppel of Oppel & Goldberg PLLC in Houston.
