Ross Dress For Less customer allegedly injured from defective clothing rack, suit claims

GALVESTON — A customer alleges she suffered injuries at a Ross Dress For Less store when a clothing rack fell apart. 

Sarah Walden filed a complaint April 3 in Galveston County District Court against Ross Stores Inc., and Ross Dress For Less Inc., alleging negligence. 

Walden, according to her complaint, was shopping at Ross Dress For Less in League City on Aug. 9, 2021. She claims that a clothing rack display fell apart and caused her to suffer injuries to her foot and other parts of her body. 

Walden further alleges the rack was in a defective state and was in need of repair and maintenance. She claims Ross should have known the rack was defective and posed a hazard. 

She also claims Ross failed to inspect its premises and clothing racks and failed to train or supervise its employees to prevent hazards. Walden alleges Ross also failed to warn of the dangerous condition of the clothing rack which caused her to suffer pain, disfigurement and to incur chiropractic, hospital and pharmaceutical expenses.

Walden seeks monetary relief, interest and all other just relief. She is represented by Lawrence Tylka and Tyler Tylka of The Tylka Law Center PC in League City.
