Man alleges hidden electric cable used for holiday lights caused his fall, sues for $1M plus

HOUSTON — A man alleges he tripped over a hidden electrical cable that had been installed for lights during the holiday season and suffered injuries. 

David Kish filed a complaint April 17 in Harris County District Court against Sterling Association Services Inc., alleging negligence. 

According to Kish's complaint, he was walking near Fountainhead Drive and Veterans Memorial Drive in Houston on Dec. 28, 2021. He alleges that he fell over a "hidden green" electric cable that was installed in a Crepe Myrtle and ran directly onto the walking path and landed on the street. Kish claims Sterling's negligence for failing to properly maintain the property or provide a warning of the hazard. 

He also alleges Sterling failed to properly train its employees on how to eliminate the dangerous condition or inspect the property in a timely manner. Kish claims as a result of his fall, he suffered pain, mental anguish, impairment, disability and lost and reduction in wages. He also claims he incurred medical treatment expenses. 

Kish seeks monetary relief of more than $1 million, trial by jury and all other just relief. He is represented by Loren Klitsas of Klitsas & Vercher PC in Houston.
