Harris County man sues alleging raised sidewalk caused his fall

HOUSTON — A Harris County man alleges he suffered injuries from a raised portion of a sidewalk outside a business in Houston. 

Dina Mireles filed a complaint April 17 in Harris County District Court against Brookfield Properties USA II LLC alleging negligence. 

According to Mireles' complaint, he was on the defendant's property on Fannin Street in Houston on Sept. 21, 2022. He claims he was walking on the sidewalk in a private drive when a portion of the sidewalk had a sudden elevation which caused him to fall. 

Mireles alleges there were no wet floor signs or entrance rugs in the area at the time and that the defendant failed to make its premises safe and allowed the dangerous condition to exist. 

He also alleges the defendant's employees knew or should have known of the hazard and the likelihood to cause serious injury. He claims as a result of his fall, he suffered pain, mental anguish, lost wages and incurred medical expenses. 

Mireles seeks monetary relief of no more than $73,500, interest and all other just relief. He is represented by Ciro Samperi of Criaco & Samperi in Houston.
