Ross Dress For Less customer sues claiming employee struck her with shopping cart

HOUSTON — A Ross Dress For Less customer claims an employee struck her with a shopping cart and caused her to suffer severe injuries. 

Kamesia Wilson on behalf of the Estate of Kimberlyne Wilson, filed a complaint May 1 in Harris County District Court against Ross Dress For Less Inc., alleging negligence. 

According to the complaint, Wilson was at Ross Dress For Less on May 4, 2021. The plaintiff claims that while shopping, an employee struck Wilson with a shopping cart and caused her to be pushed forward. She further claims as a result of the incident, Wilson suffered severe personal injuries. 

The plaintiff alleges Ross Dress For Less' negligence for failing to exercise reasonable care to reduce the risk to invitees on their premises. She also alleges Ross failed to maintain its premises in a reasonably safe condition and failed to warn of the dangerous conditions. The plaintiff claims Wilson also suffered mental anguish, impairment, disfigurement, lost wages and incurred medical treatment expenses. 

Wilson seeks monetary relief of less than $74,000, interest and all other just relief. She is represented by Jeffrey McCarthy and Mike Takla of McCarthy & Associates PLLC in Houston.
