Couple allege mortgage company falsely reported delinquent payments

HOUSTON — A couple allege a mortgage company that purchased their loan withheld escrow payments and falsely reported delinquent payments to credit agencies.  

Kelly Doyle Et Al filed a complaint April 29 in Harris County District Court against Nationstar doing business as Mr. Cooper alleging breach of contract and and violation of the Texas Fair Debt Collection Act. 

According to the plaintiffs' complaint, they originated a mortgage with an escrow account feature that allows them to pay their own taxes and insurance costs outside of the mortgage. They claim the mortgage was purchased by Nationstar and in July of 2020, the defendant illegally withheld amounts of escrow and failed to credit payments properly while threatening foreclosure on their loan. 

They further claim the defendant has demanded higher payments than agreed and that the has a history of falsely reporting delinquent payments to credit reporting agencies. The plaintiffs allege Nationstar has also refused to accept and apply payments and misrepresented the balance due on their mortgage while they have complied with all the terms of the contract. 

The plaintiffs seek monetary relief of more than $1 million, interest, trial by jury and all other just relief. They are represented by Attorney David McKeand in Houston.
