Homeowner claims contractor he paid more than $300,000 failed to complete job

GALVESTON — A homeowner alleges a contractor he made more than $340,000 in payments to has failed to complete the mitigation on his property after one year. 

Doug Wheelock filed a complaint May 2 in Galveston County District Court against On Point Restoration and Remodeling LLC, Beachin' Rides and Rentals LLC and Tiffany Gibson alleging breach of contract and other claims. 

According to his complaint, Wheelock's property in Seabrook suffered extensive water damage caused by ruptured pipes during a February 2021 winter storm. He claims that due to the damage, he was displaced from his property and had to relocate. Wheelock alleges that he hired On Point for mitigation and repair of the property damage at an estimated cost of $82,902.35 which was covered by his insurance. 

He further alleges that over a course of a year, he made a total of $340,435.70 in payments, to Gibson who also owned Beachin' Rides, which was well above her initial estimates. Wheelock claims that his property is nowhere near completion and still unavailable and that the home is filled with uninstalled materials and incomplete work. He alleges that the defendant falsely claimed materials were being held by the supplier yet he found out no one had yet paid for the materials or picked them up. 

Wheelock seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Richard Simmons and Janina Wojtkowski of Waldron & Schneider PLLC in Houston.
