Commercial construction company allegedly defaulted on more than $300,000 in payments

GALVESTON — A commercial construction inspection company is facing a claim they defaulted on more than $300,000 in payments on an industrial elevator project. 

Geda USA Elevator and Material Lift Company LLC filed a complaint May 9 in Galveston County District Court against Walt's Inspection Service LLC and Walter R. King alleging breach of contract and other claims. 

According to the plaintiffs' complaint, Geda is an industrial elevator manufacturer and Walt provides inspection of commercial and office building construction. The plaintiffs claim they entered into a contract with Walt's Inspection to furnish and install an industrial elevator at an energy unit project in Bangor, Pennsylvania for $334,669. 

The plaintiffs further claim that the defendants have made "periodic" payments under the agreement with an outstanding balance of $130,668. The plaintiffs allege that Walt's has received payment from the project owner for labor, installation and materials but have failed and refuses to pay GEDA for for the full labor, installation and materials. They claim Walt's has intentionally or knowingly defrauded on the agreement and has disbursed and diverted trust funds without paying all current and past obligations. 

The plaintiffs seek monetary relief of $250,000 or less, interest and all other just relief. They are represented by Luke Gilman and Manuel Schoenhuber of Jackson Walker LLP in Houston.
