GALVESTON — A plumbing contractor working a renovation project for the Holiday Inn Club Vacations Galveston Seaside Resort is facing a breach of contract claim of more than $50,000 in unpaid debt to a supply company.
Morsco Supply LLC doing business as Morrison Supply Company filed a complaint May 8 in Galveston County District Court against TMA Plumbing LLC, Fredy Sillero, Holiday Inn Club Vacations Inc., and Silverleaf Resorts alleging breach of contract.
The plaintiff alleges in their complaint that TMA applied for an application for credit to purchase materials in November of 2019. They further allege they furnished plumbing, HVAC, lighting fixtures and appliance materials to TMA for the construction and remodeling of the Holiday Inn Club Vacations Galveston Seaside Resort.
The plaintiff claims in January of 2023, they demanded payment for $54,991.14 from TMA which the company has refused to pay. Also according to the plaintiff's complaint, they issued a lien against Holiday Inn Club Vacations and Silverleaf, who hold interests in the property. The plaintiff claims the TMA has defaulted under the contract and they provided valuable materials to TMA without receiving compensation.
The plaintiff seeks monetary relief of less than $250,000, interest and all other just relief. They are represented by William Sudela, John Herrmann and Christopher Matulis of Crady Jewett McCulley & Houren LLP in Houston.
