Condo owner claims siding contractor's negligence led to water instrusion

HOUSTON — A condo owner claims a siding contractor's negligence caused water damage to his property. 

Robert McClendon filed a complaint May 23 in Harris County District Court against D&C Contracting Inc., alleging negligence. 

McClendon, according to his suit, owns a condo at The Oaks of Woodlake which he leases to a tenant, Shirley Baker. He claims that in June of 2021, Baker told him that during a heavy rainstorm, there was a water leak near a sliding glass door in the condo. 

McClendon further claims that after reporting the water intrusion issue to the Oaks of Woodlake the gutters were cleaned. He alleges that another water leak occurred in January of 2023, after a period of heavy wind and rain which caused the Oaks of Woodlake to then caulk around the condo's bedroom window. McClendon also alleges that a third water leak also occurred in January of 2023, and that it was discovered the water instrusion was caused by a half inch gap in the siding and the outside brick wall. 

He claims the siding was negligently installed by the defendants and caused substantial damage to his condo. 

McClendon seeks monetary relief of $250,000 or less, interest, trial by jury and all other just relief. He is represented by Joshua Davis and Margaret Allbritton of The Davis Law Group in Houston.
