Man allegedly suffers injuries from log flying off tractor, sues

HOUSTON — A man who was allegedly struck by a log that flew off a tractor and suffered a broken arm is claiming negligence. 

Troy Smith filed a complaint May 23 in Harris County District Court against Southeast Forklift Services LLC and Cody Griffis alleging negligence.

Smith, according to his complaint, was standing by one of the buildings near his property on Ellis School Road in Baytown on Sept. 7, 2022. He claims that he was struck by a log that flew off a tractor driven by Griffis being used in the field adjacent to the area. Smith claims he suffered a broken arm and required hospitalization. 

He alleges the defendants failed to keep a proper lookout, failed to take evasive action and did not safely manage the space around the tractor. He also alleges Griffis was not paying attention while driving the tractor. Smith claims he also suffered mental anguish, loss of earnings, disfigurement and impairment. 

Smith seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Vic Bonner of The Bonner Law Firm PC in Houston.
