Man alleges breach of contract in alleged business loan default

GALVESTON — A man alleges his $25,000 loan to a business owner has gone unpaid and incurred $120,000 in late fees. 

Mark Gerges filed a complaint May 25 in Galveston County District Court against Joshua Fabro and Revwizards LLC alleging breach of contract, fraud and other claims. 

Gerges alleges in his complaint that in December of 2021, he loaned the defendants $25,000 with a written agreement that included details regarding interest, repayment and penalties for late payments. He claims that the defendants have paid "amounts not equal to satisfy the loan amount" which included scheduled payments of $5,000. 

Gerges further claims that due to lack of proper payments, the defendants now owe a penalty of $120,000. He claims the defendants made deceptive and fraudulent representations regarding repayment of the loan and that he and Fabro had previous business dealings which created an ongoing relationship and "expectation of future dealings." 

Gerges alleges that to date, he has only received $20,000 and that the defendants are in breach of contract. 

Gerges seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Kristi Hubbard of The Hubbard Law Firm PC in Houston.
