Company faces breach of contract for alleging failing to pay for machine

GALVESTON — A La Marque technologies company is facing a breach of contract claim over failure to pay for a machine costing more than $170,000. 

Used CNC LLC filed a complaint May 12 in Galveston County District Court against Power City Technologies doing business as Paul Hopkins alleging breach of contract. 

According to its complaint, Used CNC entered into a contract with Power City for the sale of a Big Bore Universal Turning Center machine for a $178,600. They further claim the sales agreement included Power City financing $138,600 from a third-party finance company, paying $25,000 cash upon shipment of the machine and a promissory note for the remaining $15,000 in payments of $1,000 per month for 15 months. CNC claims that Power City has only made a $5,000 payment when the machine was shipped and owes a balance of $20,000. 

They also claim Power City paid $2,000 on the promissory note with a balance of $13,000 and has a remaining $33,000 balance regarding the contract. 

CNC seeks monetary relief, interest and all other just relief. They are represented by Cris Rasco of The Rasco Law Firm in Houston.
