Restoration company alleges couple failed to pay for work at residence

GALVESTON — A restoration company alleges a Galveston couple has failed to pay more than $70,000 for a construction project on their residence. 

Circa Creation and Restoration filed a complaint May 12 in Galveston County Disrict Court against James Alan Hogan and Nicole Ann Hogan alleging breach of contract and unjust enrichment. 

According to Circa's complaint, they entered into a construction contract with the Hogans for a construction project at their residence in Galveston. Circa alleges the Hogans have failed to timely pay invoices which has interfered with Circa's progress and hiring of third-party contractors to perform the remaining work. 

Circa also alleges that the Hogans misrepresented themselves as "a partner of the plaintiff to the City and to the trades." Specifically, Circa claims the Hogans have failed to make payments in the amount of $71,874.86 and caused them reduced income for the scope of work in the amount of $100,000. 

Circa seeks monetary relief of less than $250,000, interest, trial by jury and all other just relief. They are represented by Cris Rasco of The Rasco Law Firm in Houston.
