Couple claims contractor failed to complete job, pay subcontractors

GALVESTON —A couple alleges a contractor they paid nearly $384,000 to build an addition to their home failed to complete the job or pay subcontractors. 

Dan Middlebrooks and Robin Middlebrooks filed a complaint June 7 in Galveston County District Court against Buccaneer Construction LLC alleging breach of contract and violations of the Deceptive Trade Practices Act. 

The Middlebrooks, according to their complaint, entered into a contract in February of 2022, with Buccaneer to build an addition to their home on West Bayside Way in Galveston. They claim the contract price as $362,000 and that after the construction began to progress in March of 2022, the price changed to $384,365 due to modifications. 

The Middlebrooks allege that after paying almost the full contract price to Buccaneer, the construction was delayed on several occasions, the defendant left the job unfinished and that Buccaneer failed to pay one or more subcontractors which put them at risk for liens on their property. They claim that due to the Buccaneer's breach of contract, they paid $57,722.34 to other parties to complete the construction. 

The Middlebrooks seek monetary relief, interest, trial by jury and all other just relief. They are represented by David Salyer and Kurt Gonzalez of McLeod, Alexander, Powel & Apffel PC in Galveston.
