Woman sues H-E-B after slipping but not falling

GALVESTON — A woman is suing H-E-B after allegedly losing her footing on water at their store in Texas City and suffering injuries. 

Kathleen M. Luckie filed a complaint June 5 in Galveston County District Court against H-E-B, LP alleging premises liability and other claims. 

According to her complaint, Luckie was at H-E-B on Palmer Highway in Texas City on June 7, 2021. 

"On that date, Plaintiff was a 42 year old female customer at H-E-B... when she slipped, and lost her footing, but did not fall to the floor," the suit states. "This was due to water on the floor and exacerbated a preexisting left foot injury that required her to seek surgery to that foot a second time." 

She alleges the defendant failed to maintain a safe premises or warn of the dangerous condition. She also alleges the defendant did not employ or retain adequate maintenance services for the premises to keep it free from defects or hazardous conditions. 

Luckie claims she also suffered impairment, mental anguish and incurred medical expenses as a result of the water that was on the floor. 

Luckie seeks monetary relief between $250,000 and $1 million, interest, trial by jury and all other just relief. She is represented by Jack Ivey of The Ivey Law Firm PC in Houston.
