Mercedes Benz owner alleges Take 5 ruined engine with wrong oil

HOUSTON — A Mercedes Benz owner alleges her car's engine was ruined after an oil and filter change at Take 5. 

Fern Oglesby filed a complaint July 5 in Harris County District Court against Take 5 Properties SPV LLC alleging breach of contract and other claims. 

According to her complaint, Oglesby took her 2011 Mercedes Benz C300 to Take 5 on June 15, 2022, for an oil and filter change. She alleges that shortly after the oil change, her vehicle began smoking from the engine and exhaust. She claims that after taking the car to the Mercedes Benz dealership auto mechanic, they found significant damage due to the wrong oil being put in the car. 

Oglesby alleges that Take 5 refused to compensate her for the unworkmanlike services and destroying her car's engine which cost her an estimated $8,233.22. She also alleges Take 5 failed to reasonably investigate and evaluate her vehicle and violated the Deceptive Trade Practices Act. 

Oglesby seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Brandon Kinard, Abraham Garcia and Carlos Saldana of Abraham Garcia in Houston.
