A woman is suing a Texas City water park for a minimum of $250,000 in damages after an accident with an umbrella during a visit in 2021.
According to court discovery documents, Megan Huerta filed a complaint Aug. 17 in the 405th District Court of Galveston County against Lagoon Development, LLC; Arm Lagoon Texas City, LLC; Land Tejas Lago Mar, LLC; Cleartide Management Group, LLC; Lago Lagoonfest Texas, LLC; Lagoon Fest, LLC; Land Tejas Texas City, LTD; and Land Tejas Corporation.
The complaint says that on or about Sept. 18, 2021, the plaintiff was on the defendants’ premises on 12600 Crystal View Boulevard in Texas City (Lagoonfest Texas) when “an unsecured umbrella fell,” striking her and causing serious injuries. As a result, the filing says, she underwent therapy, diagnostic testing and injections.
The complaint alleges negligence through several acts and omissions, including that the defendants failed to properly train their employees and failed to ensure the umbrella was properly secured. The complaints says the defendants “failed to act with ordinary care under these circumstances in order to prevent this type of foreseeable incident from occurring.”
The plaintiff is suing for actual damages. She is also requesting damages for past and future pain and suffering, medical expenses; mental anguish; impairment; disfigurement; lost wages; and loss of the enjoyment of life. She seeks pre-judgment and post judgment interest, and all other just relief.
