Man sues car dealership after being denied warranty coverage on new car

A man has filed a lawsuit against a Houston-area car dealership after he purchased a vehicle with what he thought would be an extended warranty, then was denied coverage for repairs.

According to court discovery documents filed Sept. 5 in Harris County District 133 Court, Andrzej Turon filed suit against Veilani Investments, d.b.a TX Auto Group, after he bought a 2010 Hyundai Genesis from the dealership on Feb. 6. According to the suit, Turon bought an extended warranty - referred to in the suit as a "day-one warranty," meaning coverage was supposed to start on the day of the purchase.

Turon picked the vehicle up on Feb. 9, after which the "check engine" light came on, the suit states. Turon took the car to Caliber Auto Care, which told him the vehicle's codes had been "cleared" before it was sold to him, and the shop couldn't accurately diagnose the problem. Upon further review, it was found that the vehicle's transmission needed to be replaced, but when Turon attempted to use the warranty for the repair, the dealership told him that he did not have a "day one" warranty, and the repairs would not be covered because they existed when he bought the car. The suit also stated that two shops suggested he return the car, which the dealership refused. 

The suit seeks damages of less than $250,000, alleging multiple violations of the Texas Fair Trade Practices Act as well as fraud and fraud by nondisclosure, negligent misrepresentation, implied warranty of merchantability and implied warranty of fitness for a particular purpose. 

Turon seeks recovery fees as well as attorney fees, the suit states.
