Kroger drain pipe constituted unreasonably dangerous condition, trip & fall alleges

HOUSTON - A trip and fall lawsuit brought against Kroger is alleging a drain pipe constituted an unreasonably dangerous condition.

Seeking up to $1 million in damages, Antonio Gonzales Jr. filed his suit on Feb. 19 in Harris County District Court. 

According to the lawsuit, on Feb. 23, 2022, Gonzales was making a delivery at Kroger when tripped and fell. 

“A drain pipe on the ground constituted an unreasonably dangerous condition which Defendants knew about or should have been aware of…,” the suit states, adding that the defendant negligently failed to warn him of the dangerous condition. 

Gonzales is suing for his pain, medical expenses and impairment. 

The Law Office of Richard J. Presutti represents him.
