Settled: $10M suit alleging intoxicated patron fell on woman at Molly's Pub

HOUSTON — A $10 million lawsuit claiming a woman was knocked to the ground and injured after an intoxicated man at Molly’s Pub fell on top of her was recently settled, court records show.

Alleging negligence, Eileen Kay filed her complaint April 17, 2021, in Harris County District Court against Brobe Inc. (Molly's Pub), Findal Inc., and James Joseph Scheurich. 

According to her complaint, Kay was a patron at Molly's Pub on Ramada Drive in Houston on April 1, 2021. She alleges that Scheurich was also a patron at the pub during that time and "was obviously intoxicated" and "presented a clear danger to himself and to others." 

Kay claims that Scheurich was so drunk that he was "unable to maintain a steady footing and balance" and fell on top of her. Kay claims she was knocked to the ground and suffered "serious bodily injuries" along with mental anguish, physical impairment, loss of earnings as well as incurred medical treatment expenses. 

She claims that the defendants negligently continued to provide Scheurich with alcohol when it was obvious he was intoxicated. 

Court records show an agreed final judgment was entered on Feb. 19, stating that the plaintiff’s claims are dismissed with prejudice. 

A notice of settlement was entered a month earlier, stating that the parties have reached a settlement agreement.
