Improper placement of plastic sheeting caused man to strike head on counter, suit alleges

HOUSTON - A man is suing an apartment complex, claiming that during flood remediation work the improper placement of plastic sheeting caused his leg to become caught, causing him to fall and strike his head on a kitchen counter. 

Seeking up to $1 million in damages, Bobi Zoltan filed suit against MAA Afton Oaks, Mid-America Apartments and Lee & Barrier Builders on March 17 in Harris County District Court. 

According to the lawsuit, on March 18, 2022, Zoltan was at his MAA Afton Oaks apartment. The defendants had hired Lee & Barrier to perform flood remediation work. 

“During the course of their work, Defendant Lee & Barrier Builders’ improper placement of plastic sheeting caused Plaintiff’s leg to become caught causing him to fall forward and strike his head on the kitchen counter,” the suit states. 

“Plaintiff did not have knowledge of the unreasonably dangerous conditions due to no warning signs being placed by Defendants.” 

The plaintiff is alleging premises liability.
