Husqvarna Construction sues Highway Pavement Specialties for breach of contract

In the County Civil Court at Law No. 3 in Harris County, Texas, Husqvarna Construction Products, North America, Inc. has filed a lawsuit against Highway Pavement Specialties, Inc., also known as and doing business as Highway Pavement Specialties, Highway Pavement, and Hwy Pavement Specialties, Inc. The case was filed under Cause No. 1223384 on March 5th, 2024.

The plaintiff alleges that it sold and delivered goods and services to the defendant at their request on various dates as shown in an attached itemized account (Exhibit "A"). The total value of these goods and services is claimed to be $250,000.00 or less. The defendant allegedly failed to pay for these goods and services despite multiple requests from the plaintiff leading to damages of $112,160.39 along with interest and attorney fees totaling $37,385.00.

The plaintiff is seeking monetary relief including damages of any kind, penalties, costs, expenses, pre-judgment interest and attorneys’ fees under Level 1 of the Texas Rules of Civil Procedure. They argue that the defendant's failure to pay constitutes a breach of contract.

Represented by Totz Ellison & Totz P.C., Husqvarna Construction Products is asking for judgment against Highway Pavement Specialties for the sum of $112,160.39 plus interest at five percent per annum from 30 days after each invoice came due until judgment day along with court costs and reasonable attorneys' fees.
