A recent court filing reveals a gripping tale of alleged negligence leading to personal injury at a popular retail establishment. On April 16, 2025, Ramona Morales filed a complaint in the District Court of Harris County against Matthew R. Hooper, doing business as Houston Garden Centers, along with MMK & S, Ltd., and Quality Christmas Tree, LTD. The lawsuit centers around an incident that occurred on October 7, 2023, when Morales claims she suffered injuries due to unsafe conditions at one of the defendant's stores.
According to the complaint filed by Morales, the events unfolded at the Houston Garden Centers located at 1700 W Loop S, Houston, Texas. Morales alleges that while shopping at this location, she slipped on a wet and slippery substance on the floor which led to her falling and sustaining bodily injuries. She accuses the defendants of negligence for allowing such hazardous conditions to exist despite being aware or reasonably expected to be aware of them. The plaintiff asserts that the defendants failed in their duty to maintain a safe environment for customers by not addressing or warning about these dangerous conditions.
The lawsuit outlines several accusations against the defendants under premises liability and negligence theories. Morales claims that they negligently allowed their premises to become dangerous and failed to inspect or rectify these hazardous conditions adequately. Furthermore, she accuses them of not providing sufficient warnings about potential dangers within their store. "Defendants owed Plaintiff a duty to exercise ordinary care," states the complaint, emphasizing that as an invitee on their property, she was entitled to expect reasonable safety measures.
Morales is seeking monetary relief exceeding $250,000 but less than $1 million for damages including medical expenses (both past and future), pain and suffering, mental anguish, physical impairment and disfigurement as well as lost wages and diminished earning capacity. She demands a jury trial for her case and requests judgment against all defendants jointly and severally within jurisdictional limits.
