In the County Civil Court at Law No. 4 of Harris County, Texas, MGA Insurance Company, Inc., as subrogee of Wendell Dartest, has filed a lawsuit against Dominick Ward. The case ID is not specified in the document and the filing date is April 4, 2024. The plaintiff alleges that the defendant's negligence resulted in an automobile collision causing substantial damage to their insured's vehicle.

The incident occurred on July 2, 2022, when Dartest was operating his insured vehicle on I-H 10 Katy Freeway in Harris County. Ward, driving his own vehicle, allegedly caused a collision resulting in significant damage to Dartest's car. The plaintiff asserts that this accident was due to Ward's failure to maintain a proper lookout, apply brakes timely and appropriately, control speed and obey traffic control devices.

The damages caused by the accident required either replacement or repair of Dartest's vehicle and also led to out-of-pocket expenses for MGA Insurance Company. The plaintiff claims that these damages were directly and proximately caused by Ward's negligence. They are seeking monetary relief of less than $250,000 excluding interest, statutory or punitive damages and penalties, attorney’s fees and costs.

MGA Insurance Company is also pleading for recovery of its reasonable attorneys' fees and cost of court from Ward if he was uninsured at the time of the accident as provided for in the Texas Insurance Code. The company paid Wendell Dartest $7,074.06 under its insurance policy terms following the incident and now seeks to recover this sum from Dominick Ward.
