Stephanie Swain sues ARC Shadowlake LP for negligence and lack of adequate care

In the District Court of Harris County, Texas, Stephanie Swain, on behalf of Josephine Kimble, has filed a lawsuit against ARC Shadowlake LP (doing business as Brookdale Shadowlake), American Retirement Corporation, and Cynthia Tran. The case ID is 2024-21209 and it was filed on April 3, 2024.

Stephanie Swain, the daughter and power of attorney for Josephine Kimble, alleges that Kimble sustained injuries while under the care of Brookdale Shadowlake between March 4, 2023 to October 4, 2023. The defendants are accused of owning, managing, operating, supervising and staffing the assisted living center where Kimble resided during this period.

The lawsuit claims that all defendants were responsible for providing caregiver services to assist Kimble with her daily activities and rehabilitation. It is alleged that due to their negligence or lack of adequate care, Kimble suffered injuries.

Swain seeks damages in excess of the minimum jurisdictional limits of the court. She affirms that the court has jurisdiction as all causes of action arose in Texas and all parties are either residents or conduct business in Texas.
