Brandon Marks sues South Post Oak Venture I for elevator malfunction causing physical injuries and mental distress

In a lawsuit filed on April 12, 2024, in the District Court of Harris County, Texas (Case ID: 2024-23461), plaintiff Brandon Marks is suing defendants South Post Oak Venture I, LLC and Schindler Elevator Corporation. The case revolves around an incident involving a malfunctioning elevator that resulted in physical injuries and mental anguish for the plaintiff.

The incident occurred on October 31, 2023, at an apartment complex named Astor at Tanglewood in Houston, owned by South Post Oak Venture I, LLC. According to the court filing, Marks was trapped inside a malfunctioning elevator which experienced a sudden drop causing him physical harm and mental distress. He was rescued an hour later by the police who pried open the elevator doors.

The plaintiff seeks monetary relief over $250,000 but not more than $1,000,000. This includes damages of any kind, penalties, costs, expenses, pre-interest and attorney’s fees. The plaintiff alleges negligence on part of both defendants - South Post Oak Venture I for owning and operating the premises with a faulty elevator and Schindler Elevator Corporation for failing to maintain the elevator to standard.
