Man sues Memorial Hermann Health Systems for negligence leading to severe injuries

David Safier, acting as the next friend of Carol Ann Safier, has filed a lawsuit against Memorial Hermann Health Systems, doing business as TIRR Memorial Hermann. The case was filed in the District Court of Harris County, Texas, under the court case ID 2024-28541 on May 3rd, 2024.

The lawsuit alleges that on September 16th, 2022, Carol Ann Safier was admitted to TIRR Memorial Hermann for inpatient rehabilitation following an anoxic brain injury. She was considered a high fall risk and assigned to round-the-clock nursing monitoring. However, on October 5th, 2022, Mrs. Safier was left alone without her assigned sitter and fell off the gurney while attempting to ambulate. This resulted in a left pubic fracture and subdural hematoma.

The plaintiff accuses Memorial Hermann Health Systems of negligence in managing Mrs. Safier's care. The complaint states that the healthcare provider failed to follow fall safety precautions and ensure constant monitoring by nursing staff or a sitter. Furthermore, they allegedly failed to restrain Mrs. Safier on the gurney properly.

Safier is seeking monetary relief over $1 million for damages including physical pain and mental anguish both past and future; physical impairment; disfigurement; loss of earning capacity; loss of household services; and reasonable and necessary medical expenses both past and future.
