HOUSTON - A lawsuit is alleging that a man was shot and killed at a Primos Food Store by a man who was allowed to remain on the premises despite the danger he posed.
Seeking more than $1 million in damages, the family of Bryson Walton filed suit against Sunshine SB (Primos Food Mart) and Quoc Thang Investments in Harris County District Court.
According to the lawsuit, on Dec. 10, 2023, the now deceased 28-year-old Bryson Walton was at Primos Food Store when, suddenly and without warning, he was attacked, shot, and killed by an individual who was also at the store.
“Defendants allowed the individual who shot and killed the Decedent to remain on their premises, despite the danger he posed, without any interference whatsoever, because he was one of Defendants’ customers and/or prospective customers,” the suit states. “Defendants had actual and constructive knowledge that similar criminal activities had occurred in the recent past within close proximity of the subject premises on a frequent basis.
“Nonetheless, Defendants provided no security whatsoever.”
The suit is alleging gross negligence.
The plaintiffs are represented by attorney Bilaal Badat, along with Jennifer Stogner and Brant Stogner of Abraham Watkins.
