Man finds foreign object in his food, results in personal injuries while eating at Pappasito's Cantina

Eric Washington has filed a negligence complaint against Pappas Restaurants, Inc., doing business as Pappasito’s Cantina. The complaint was filed in Harris County Civil Court at Law No. 1 on May 24, 2024.

According to the court documents, Eric Washington, a resident of Harris County, Texas, alleges that on September 16, 2023, while dining at Pappasito’s Cantina located at 13750 Southwest Freeway in Sugar Land, Texas, he bit into a foreign object in his food and sustained personal injuries. Washington claims that the food was manufactured and served by Pappas Restaurants, Inc., and that the presence of the foreign object constituted an unreasonably dangerous condition. He further asserts that the defendants knew or should have known about this condition and failed to either ameliorate it or warn him about it.

The plaintiff's petition outlines several specific acts of negligence attributed to Pappas Restaurants and its employees. These include failing to manufacture food in a consumable state, serving food with a foreign object in it, failing to warn customers about potential hazards in their food, failing to reasonably inspect and discover dangerous conditions in the food served, and failing to take corrective actions after knowing about the existence of such conditions. Washington argues that these acts of negligence directly caused his injuries.

Washington is seeking damages for physical pain and mental anguish both past and future, medical expenses incurred and anticipated due to the incident, as well as physical impairment suffered as a result of biting into the foreign object. He has requested that a jury determine the fair amount of compensation for his damages. Additionally, he seeks pre-judgment and post-judgment interest as allowed by law, court costs, and any other relief deemed just by the court.
