Harris County resident sues local grocery store when they slip on rice

A Harris County resident has taken legal action against a local grocery store chain following an incident that left her injured. Elisa Mosso Mendez filed a complaint in the District Court of Harris County, Texas, on May 30, 2024, accusing Lewis Food Town, Inc. of negligence.

According to the court documents, Mendez was shopping at a Lewis Food Town store located at 121 Broadway Street in Pearland, Texas when she slipped on rice that had been left on the floor. The plaintiff asserts that the fall resulted in significant bodily injuries and property damage. Mendez claims she was an invitee at the store and that it was the defendant's responsibility to ensure a safe environment for its customers. "Defendant owed a legal duty to Plaintiff," reads the petition, highlighting multiple failures by Lewis Food Town including not maintaining a reasonably safe condition in their premises and failing to warn customers about dangerous conditions.

The complaint further outlines specific acts of negligence attributed to Lewis Food Town: failing to correct hazardous conditions, inadequate inspection procedures, insufficient employee training regarding safety protocols, and lack of proper policies to ensure customer safety. Mendez insists these oversights directly led to her accident and subsequent injuries.

In her lawsuit, Mendez is seeking monetary relief exceeding $250,000 but less than $1 million. She lists various damages including past and future medical expenses, physical pain and suffering, physical impairment both past and future, loss of earnings and earning capacity, loss of consortium (both past and future), loss of household services (both past and future), disfigurement (both past and future), mental anguish (both past and future), as well as property damage. Additionally, she requests exemplary damages due to what she describes as Lewis Food Town's "extreme degree of risk" behavior with "conscious indifference" towards customer safety.

Mendez has also demanded a jury trial for this case. Her attorney from Marcos & Associates P.C., Kristin Zuniga (Texas Bar No. 24073615), has formally requested disclosures from the defendant within 30 days as per Texas Rules of Civil Procedure 194. The case is set before Judge Kenylone Asbery in Court 333 under Case ID 2024-34083.
