In a compelling legal battle, the daughter of a deceased nursing home resident has filed a lawsuit against a prominent medical resort, alleging negligence that led to her mother's untimely death. Lisa Jackson, representing herself and the estate of her mother, Marie Schmidt, lodged the complaint on October 9, 2024, in Harris County, Texas. The defendants named in the suit are Ignite Medical Resort Webster LLC and its associated entities.

The lawsuit outlines grave accusations against Ignite Medical Resort Webster and its affiliates for failing to provide adequate care to Marie Schmidt during her stay from June 6 to June 19, 2023. According to the petition filed by Jackson, Schmidt was admitted to the facility following hip surgery and was at high risk for blood clots due to pre-existing conditions such as hypertension and an aneurysm. Despite these known risks, Jackson claims that Ignite Medical Resort neglected her mother's care needs. The complaint details instances where Schmidt was denied assistance with basic tasks like getting off a bedpan and did not receive prescribed pain management or rehabilitative care.

Jackson's petition accuses the defendants of breaching their duty of care under Texas law by failing to monitor Schmidt's health adequately and ignoring established care plans tailored for her condition. The lawsuit also highlights systemic issues within the facility's operations, including understaffing and inadequate training of medical personnel. "Defendants' negligence directly resulted in severe injuries and ultimately led to Marie Schmidt's death," asserts Jackson in her filing.

The plaintiff seeks various forms of relief from the court, including economic damages exceeding jurisdictional limits for past medical expenses and funeral costs. Additionally, she requests non-economic damages for emotional distress suffered by herself as a wrongful death beneficiary. In pursuit of justice for her mother’s suffering and subsequent passing due to alleged neglectful practices at Ignite Medical Resort Webster, Jackson demands punitive damages aimed at deterring similar conduct by healthcare providers in the future.
