Customer Sues Grocery Chain Over Slip-and-Fall Incident

A slip-and-fall incident at a local grocery store has led to a lawsuit that could have significant implications for business owners and patrons alike. On June 14, 2024, Zoila Callejas filed a complaint in the District Court of Harris County, Texas, against The Kroger Co., Kroger Texas LP, and "Kroger," alleging negligence that resulted in serious bodily injuries.

According to the complaint, on September 22, 2023, Callejas was shopping at the Kroger located at 12620 Woodforest Blvd., Houston, Texas. During her visit, she slipped on chicken juice left on the floor and sustained severe injuries. Callejas asserts that the defendants were negligent in maintaining a safe environment for their customers. The lawsuit states that the defendants failed to inspect and clean the premises adequately and did not warn customers about the hazardous condition.

Callejas is seeking damages for physical pain and disability from the date of injury until trial, future physical pain and disability, mental anguish and suffering both past and future, loss of earnings and earning capacity, medical expenses incurred from date of injury until trial as well as those anticipated in the future for treatment of her injuries. Additionally, she claims compensation for past and future physical disfigurement and impairment. In total, Callejas is asking for monetary relief not exceeding $250,000.

The plaintiff's attorney Richard J. Nava emphasizes that nothing Callejas did or failed to do contributed to her accident or resulting injuries. The complaint also invokes the doctrine of Respondeat Superior, holding The Kroger Co., Kroger Texas LP, and "Kroger" responsible for their employees' actions during their course of employment.

Callejas has requested a jury trial to resolve this matter. The case will be presided over by Judge Christopher Matthews under Case ID: 2024-37732.
