Tenant Sues Property Management Companies Over Severe Injuries Due To Negligence

A Harris County resident has filed a lawsuit against two property management companies, alleging severe injuries due to their negligence. On June 28, 2024, Jesus Serna filed a complaint in the Harris County District Court against J. Legacy Assets, LLC., doing business as Berkshire Apartments, and Centra Partners, LLC.

According to the court documents, Serna claims that on January 5, 2023, he was severely injured when a hot water pipe burst in his apartment at Berkshire Apartments in Houston. The incident caused part of the ceiling to collapse and hot water to pour onto him while he was asleep. Serna alleges that this resulted in serious burns and injuries to his head, back, and arms. He further contends that the defendants had prior knowledge of ongoing plumbing issues but failed to take adequate measures to fix them or warn tenants about the potential dangers.

The plaintiff asserts that this was not an isolated incident; there had been previous plumbing problems at the Berkshire Apartments which had caused property damage before. Despite being aware of these issues, the defendants allegedly did not perform necessary inspections or repairs and failed to inform tenants about the hazardous conditions. "Defendants breached their duty by failing to keep their tenants safe," states Serna in his petition.

Serna is seeking monetary relief between $200,000 and $1 million for medical expenses, physical pain and suffering, mental anguish, physical impairment, and property damage. He also demands a jury trial and requests initial disclosures from the defendants under Texas Rules of Civil Procedure 194.

Representing Jesus Serna is attorney Juan Rodriguez from Rodriguez & Associates PLLC. The case is assigned to Judge Joshua Hall of the 125th Judicial District Court under Case ID 2024-41456.
