A Harris County resident has filed a lawsuit against a local health services company, alleging negligence after suffering severe injuries on their property. The complaint was filed by Katina Ben Shields in the District Court of Harris County, Texas, on July 3, 2024, naming Deblin Health Concepts and Associates LLC as the defendant.
According to the court documents, the incident occurred on June 20, 2024, when Shields was visiting the defendant's property at 1214 N. Post Oak Rd., Suite 100 in Houston. Shields claims she was leaning against a glass window outside the building while smoking a cigarette when the window shattered unexpectedly. This sudden breakage nearly caused her to fall through and resulted in severe injuries. Shields asserts that as an invitee on the premises, she had no knowledge of any dangerous conditions and could not have reasonably expected to discover them.
The plaintiff argues that Deblin Health Concepts and Associates LLC knew or should have known about the hazardous condition of the glass window but failed to correct it or warn her about it. "Defendant either created the condition and/or failed to correct it or to warn Plaintiff about the dangerous condition," states the complaint. This alleged negligence forms the basis for Shields' claims under premises liability law.
Shields is seeking monetary relief of $250,000 or less, excluding interest and statutory damages. She has outlined several specific areas where she believes compensation is warranted: past and future medical expenses, pain and suffering, mental anguish, physical impairment, and disfigurement. Additionally, she is asking for pre-judgment and post-judgment interest along with all court costs.
