Truck Driver Sues Multiple Corporations Over Negligence Leading to Severe Injury

A truck driver is suing multiple corporations for injuries sustained due to alleged negligence in loading and securing cargo. Yunieski Riveron Gonzalez filed the complaint on July 8, 2024, in Harris County District Court against Ferguson Enterprises, LLC, Armstrong Transport Group, LLC, and Nucor Corporation.

According to the lawsuit, Gonzalez was injured on December 1, 2022, while delivering cargo loaded by Nucor Corporation at a Ferguson Enterprises location. The plaintiff claims that the defendants failed to secure heavy metal scaffolding properly on his truck. When Gonzalez removed the straps holding the cargo as instructed by Ferguson Enterprises' agents, a piece of scaffolding slid off and struck him. The lawsuit alleges that no safety equipment or assistance was provided during this process.

Gonzalez contends that both Ferguson Enterprises and Nucor Corporation had control over the premises and were responsible for maintaining a safe environment. He argues that their failure to do so constitutes negligence under Texas law. The complaint also implicates Armstrong Transport Group as the broker responsible for ensuring transport safety but failing in its duty.

The plaintiff seeks damages exceeding $1 million for medical expenses, physical pain and suffering, mental anguish, loss of earnings, impairment, and disfigurement. He demands a jury trial and requests pre-judgment interest from the date of injury through judgment date, post-judgment interest at the legal rate, court costs, and any other relief deemed appropriate by the court.
